Maximum punishments were introduced into the Colony through legislation passed by the Legislative Council. An Ordinance abolishing minimum punishments on convictions before Magistrates met with the hearty support of all, but especially the legal Members of the Council.

At the time when such novel provisions were introduced into the legislation of the Colony, there was great doubtless departure from the ordinary course of Courts.

That time has happily passed, and the continuance of such restrictions upon the discretion of the adjudicating Magistrates operates to the detriment of the proper administration of "the Justice."

I am of the opinion that your Lordship will approve of the enclosed Ordinance to abolish Minimum punishments on Summary Convictions before Magistrates (R: 2 of 1873), and submit it for Her Majesty's gracious confirmation.
